1. Acceptance of Terms

By accessing, logging in, signing up, or utilizing Imaginestacks ("Platform", "we", "us", or "our"), you explicitly agree to be bound by these Terms & Conditions. If you do not agree, you may not use our services.

Imaginestacks provides an AI Model Brokerage Platform allowing you to interface with third-party generative AI models. By using our platform, you also automatically agree to and accept the Terms & Conditions and Acceptable Use Policies of our underlying service providers (such as Replicate and any other integrated AI model hosts).

2. Subscriptions, Credits, and Payments

  • Credit System: AI generations are priced dynamically based on parameters such as resolution, duration, modality, and the underlying provider's cost. You must maintain a positive credit balance to generate content.
  • Payments: All payments are processed securely via our payment gateway partner (Razorpay). By submitting payment information, you authorize us to charge the applicable fees via your selected payment method.
  • Subscriptions: Subscription plans provide a recurring allocation of credits and are billed on a periodic basis until canceled.
  • Refunds: All purchases of credits and subscriptions are final and non-refundable, except where required by applicable consumer law. We do not provide refunds for failed AI generations caused by invalid user prompts or external provider outages, though we may issue credit refunds at our sole discretion.

3. Acceptable Use and Restrictions

You agree not to use Imaginestacks to:

  • Generate or distribute illegal, sexually explicit, highly violent, or non-consensual content.
  • Violate the intellectual property rights, privacy rights, or terms of service of any third party or the underlying AI providers (e.g., Replicate).
  • Attempt to exploit, manipulate, or bypass our billing, credit deduction, or security mechanisms.

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice or refund.

4. Intellectual Property of AI Output

Imaginestacks claims no ownership over the prompts you input or the specific assets generated ("Outputs"). Subject to your compliance with these Terms and the licensing terms of the underlying open-source or proprietary models used, you are permitted to use the Outputs for personal and commercial purposes. You acknowledge that AI-generated content may not be fully protected by copyright law in certain jurisdictions.

5. Service Availability and Provider Dependency

Our platform relies on third-party infrastructure. We do not guarantee uninterrupted access to specific models. We reserve the right to add, modify, or disable models or modalities (Image, Video, Audio) at any time. Wait times and generation speeds are subject to external provider capacity.

6. Limitation of Liability

To the maximum extent permitted by law, Imaginestacks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or digital assets, resulting from your use or inability to use the service.

7. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the platform after changes have been communicated constitutes your acceptance of the revised Terms.
